Welcome to Sketch Commerce Live (“Sketch Commerce,” “we,” “our,” or “us”). By visiting our website, purchasing our services, engaging with our content, or collaborating with our team, you (“you,” “brand,” “client,” or “customer”) agree to the following Terms of Service.

Please read them carefully before using our website or purchasing any creative services.

1. Overview

Sketch Commerce Live is a creative studio and production company offering comedic advertising content and promotional collaborations for brands. All services sold on this website are digital services, creative deliverables, or content-based collaborations.

By using our website or purchasing any service, you agree to comply with these Terms of Service and all applicable laws.

2. Eligibility

By accessing or using this website, you confirm that:

  • You are at least 18 years old.

  • You are authorized to make purchasing decisions on behalf of your company or brand (if applicable).

  • You will provide accurate payment, account, and contact information.

3. Services

Sketch Commerce Live offers the following categories of services (exact offerings may change over time):

  1. Comedic short-form ads

  2. Performance ads / UGC-style comedic spots

  3. Brand collaboration packages

  4. Custom creative projects

  5. On-site business visits (when applicable)

Each service is described in detail on its respective product page. Deliverables and timelines vary based on the scope purchased.

We reserve the right to:

  • Modify service offerings

  • Adjust pricing

  • Limit service availability based on schedule or fit

  • Decline projects that are not aligned with our creative style or ethical guidelines

4. Booking & Payment

4.1 Payment Terms

Payment is required upfront to secure your shoot date, production resources, actors, and editing time.

We accept payments through Shopify-supported payment processors (e.g., credit card, Shop Pay, Apple Pay, Google Pay, etc.).

4.2 Refunds

Due to the custom and time-intensive nature of creative production, all sales are final.

Refunds are only offered if Sketch Commerce cancels the project and cannot reschedule. For more details, please review our Refund Policy, which is incorporated by reference into these Terms.

4.3 Rescheduling

If you need to reschedule, you must notify us at least 7 days before the scheduled shoot date. Rescheduling is subject to availability and may not always be possible.

5. Client Responsibilities

To ensure a successful production, you agree to:

  • Provide accurate product information and claims.

  • Supply products or samples in a timely manner (shipping costs covered by the client).

  • Deliver any required brand guidelines, talking points, disclaimers, or legal review notes before production.

  • Review drafts and cuts within the timelines provided.

Failure to provide necessary assets or timely feedback may delay your project and does not entitle you to a refund.

6. Creative Direction & Production

By purchasing, you acknowledge and agree that:

  • Sketch Commerce Live specializes in comedic, character-driven creative, and your final deliverables will reflect that tone.

  • Creative decisions—including framing, tone, characters, pacing, editing choices, and comedic style—remain at the discretion of Sketch Commerce.

  • Included revision rounds are limited to what is listed on the product page. Additional revisions may incur extra costs and must be agreed upon in writing.

7. Licensing & Usage Rights

7.1 Usage Rights for Brands

Unless stated otherwise on the product page or in a separate written agreement:

  • You receive a non-exclusive, worldwide license for up to one year to use finalized videos for:

    • paid advertising (e.g., Meta, TikTok, YouTube, Google),

    • organic social media,

    • email marketing,

    • website content and landing pages, and

    • internal presentations.

  • You may not:

    • resell the content as a standalone asset,

    • sublicense it to other agencies or networks, or

    • use it in television, OTT, or traditional broadcast without our prior written consent and an updated license agreement.

7.2 Usage Rights for Sketch Commerce Live

By engaging our services, you grant Sketch Commerce the right to:

  • Feature your content and brand name or logo in our portfolio, website, and social channels.

  • Use clips, stills, and behind-the-scenes content in our own organic and paid marketing.

  • Re-edit or remix footage for the purpose of showcasing our work.

If you require exclusivity (e.g., content not shown in our portfolio or social channels), this must be negotiated separately and will typically involve an additional fee.

8. Actors, Characters & Talent Rights

Sketch Commerce Live uses recurring comedic characters (such as Sterling & Savannah, Melody Starr, Morty & Cheryl, and others).

You acknowledge that:

  • All character concepts, storylines, and personas remain the intellectual property of Sketch Commerce Live.

  • You do not obtain ownership of characters, actors’ likenesses, or personas.

  • The same actors and characters may appear in content for other brands, unless a separate exclusivity agreement is signed.

Talent usage and buyout terms may be further detailed in separate talent or usage agreements, which will govern in the event of any conflict.

9. Turnaround Times

Delivery timing varies by package. Standard windows typically range from 7-21 business days from the time we receive:

  • full payment,

  • all required products or samples, and

  • any necessary brand assets or guidelines.

Delays caused by missing client assets, product shipping issues, or events outside our control (see Section 13, Force Majeure) may impact timelines.

10. Content Approval & Revisions

  • You will receive a draft version (or versions) based on your selected package.

  • The number of included revision rounds is shown on the product page.

  • Revision requests must be reasonable and consistent with the original agreed-upon concept. Major re-writes, re-shoots, or substantial creative pivots may require additional fees.

Unless otherwise agreed:

  • You must provide revision feedback within 5 business days of receiving a draft.

  • If no feedback is received within that window, the content may be deemed accepted and finalized.

11. Prohibited Uses

You may not use Sketch Commerce Live content in a manner that:

  • Violates any applicable law or advertising regulation.

  • Includes false, misleading, or unsubstantiated claims about your product.

  • Promotes hate, harassment, discrimination, or illegal activity.

  • Involves adult content, political campaigns, or unsafe/illegal products, unless specifically agreed upon in writing and compliant with platform policies.

We reserve the right to decline or terminate projects that conflict with these standards.

12. Limitation of Liability

To the fullest extent permitted by law:

  • Sketch Commerce Live is not liable for any indirect, incidental, consequential, or special damages, including lost profits or lost revenue.

  • We do not guarantee specific performance results (ROAS, sales, views, engagement, etc.).

  • Our total aggregate liability for any claim arising out of or related to our services is limited to the total amount you paid for the specific service at issue.

Some jurisdictions do not allow limitations of liability; in such cases, the above may be modified to the minimum extent required by law.

13. Force Majeure

We are not responsible for delays or failures in performance caused by events beyond our reasonable control, including but not limited to: natural disasters, power outages, platform outages, strikes, wars, pandemics, or other unforeseen events (“Force Majeure Events”).

14. Privacy

Your use of this website is also governed by our Privacy Policy, which explains how we collect, use, and protect personal information.

By using the site, you consent to the collection and use of information as described in the Privacy Policy.

15. Governing Law

These Terms of Service are governed by and construed in accordance with the laws of the State of North Carolina, without regard to its conflict of laws principles.

Any disputes shall be resolved in the state or federal courts located in North Carolina, and you consent to the jurisdiction of those courts.

16. Changes to These Terms

We may update these Terms of Service from time to time. When we do, we will update the “Last Updated” date at the top of this page.

Your continued use of the website or services after any changes are posted constitutes your acceptance of the updated Terms.
